The US Supreme Court has issued its ruling on same-sex “marriage.” In its narrow 5-4 decision, the Court continued a run of rulings which place in doubt the purpose of the Court, and the future of democracy, itself.

What happened in the ruling and how can we respond?

In its ruling, the Court made state laws defining marriage as between one man and one woman “unconstitutional”. In doing so, it has sought to redefine an institution which has existed since time immemorial, and which has served as the fundamental building-block of society; and, it has further diminished the separation of powers (in this case, those which the Federal government enjoys, and those reserved to the individual states), which, till now, always gave the states the freedom to regulate marriage.

Even after this disastrous judgment, the fact remains that there is nothing in the Constitution which requires that all 50 states redefine marriage.

As Chief Justice Roberts said, in his dissent, about the Constitution’s role in this decision: “It had nothing to do with it.”

And, Justice Scalia went further, saying that, the Supreme Court is itself becoming a, “threat to American democracy.”

Specifically, Scalia said: “Today’s decree says that my Ruler, and the Ruler of 320 million Americans coast-to-coast, is a majority of the nine lawyers on the Supreme Court…[And,]…a system of government that makes the People subordinate to a committee of nine unelected lawyers does not deserve to be called a democracy.

And worse still, it took a sledge-hammer to the natural family and a child-centered view of family law.

So, what do we do now???

We must fight back!

And, the first step must be to support the First Amendment Defense Act (FADA), which was just introduced in Congress last week by Sen. Mike Lee (R-UT) and Rep. Raul Labrador (R-ID).

Of course, we must work to rescind the Supreme Court’s terrible ruling, but, right now, one of our first priorities must be to secure the right to express our objection to the same, and to act in accordance with our beliefs.

And that’s what the FADA does.

FADA is straight-forward and says: “…the Federal Government shall not take any discriminatory action against a person, wholly or partially on the basis that such person believes or acts in accordance with a religious belief or moral conviction that marriage is or should be recognized as the union of one man and one woman, or that sexual relations are properly reserved to such a marriage.”

We conservatives and Christians need to demand that our Congressmen pass this Bill. Our public servants need to hear from us, telling them that we are fast losing confidence in our “democratic” processes, and that they need to act now to restore that confidence.

We will not be silenced, and we cannot violate our consciences by acting in contradiction to them!

So, now, the law must vindicate our absolute right to disagree with this ruling and all it implies.

Pass the First Amendment Defense Act (FADA)

Dear Leaders of the House and Senate, Speaker Boehner and Senate Majority Leader McConnell:

I am dismayed by the recent ruling by the Supreme Court which arrogates to itself, the right of the states (and, therefore, the People of the states) to regulate marriage - a right which has always been the domain of states. As the Chief Justice, himself, put it, this ruling, "has nothing to with [the Constitution]."

This display of raw judicial activism is frightening because 5 people have had the sheer arrogance and audacity to attempt to redefine, in law, the un-redefinable. As you know, marriage, as between one man and one woman, is older than written history and government itself. And, the opinion of 5 legal geniuses cannot change fundamental human nature.

This display was also frightening because it shows the limitations of our form of democracy when the judicial branch abandons its sacred duty to guard, with special care, the unique system of checks and balances, of which the separation of powers (between the states and the federal government) is an integral part.

It is apparent that the situation resulting from the Supreme Court judgement in Obergefell v. Hodges requires serious attention. Our imperiled democracy demands it.

But, in the meantime and in this context, it is perhaps equally important, though, more urgent, that measures are now taken to safeguard, in law, our First Amendment rights - so that people who sincerely disagree with the Supreme Court's ruling, and what it implies, can be legally protected in their right to express their objection to this ruling, as well as their freedom, in law, not to act against their conscience in any related issue, be it in the workplace, in the public square, at home, in school, or anywhere at all.

For these reasons, I am asking you to support and promote the passage of the First Amendment Defense Act (S. 1598 and H.R. 2802).

It is essential that Congress play its role in helping to ensure that our system of democracy, and that We The People are defended against erroneous judgements of the Supreme Court. By doing so, you will also help to restore the definition of marriage as between one man and one woman, as the legally normative definition for the United States, which can only benefit society and the children of our country.
